Accepted dissertation submitted to Suffolk University School of Law written by Kissinger N. Sibanda decries the decision in the Erdemovic case in the International Criminal Tribunal for Yugoslavia as procedurally unfair. He argues for a remodelling of the "superior orders," defense; suggesting as reform, the United States' own anti-trust -"rule of reason," which offers a solution to the current predicament. The title, "JONGA," is a Xhosa word meaning to look closely or close enough, to further discern the facts.
