Die strafrechtlichen Ermittlungen im Zusammenhang mit den sog. Cum/Ex-Geschäften dauern in Deutschland nun schon fast zehn Jahre an. Ihr Ende ist nicht in Sicht ¿ im Gegenteil: Es kommen immer noch neue Fälle und Gestaltungsvarianten dazu. Der Autor widmet sich den steuerlichen und steuerstrafrechtlichen Kontroversen der Cum/Ex-Geschäfte. Hierfür zeigt er als Subsumtionsgrundlage für die rechtliche Bewertung zunächst die bislang nur grob oder lückenhaft dargestellten technischen und zivilrechtlichen Besonderheiten bei der Abwicklung von Aktiengeschäften über den Dividendenstichtag auf. Die daran anschließende steuerliche Bewertung richtet er mit Blick auf das Ultima-Ratio-Prinzip des Strafrechts an den von der Steuerrechtsprechung aufgestellten Grundsätzen aus. Bei der strafrechtlichen Bewertung gelangt er schließlich zu dem Ergebnis, dass Cum/Ex-Geschäfte grundsätzlich als Steuerhinterziehung strafbar sind. Dabei werden die Grenzen des objektiven und subjektiven Verhaltensunrechts beider Steuerhinterziehung bestimmt, nach einem eigenen Lösungskonzept fortentwickelt und Überlegungen zu Täterschaft und Teilnahme angeschnitten.

This proceedings volume results from the NATO Advanced Research Workshop on 'Biomarkers of Radiation in the Environment: Robust Tools for Risk Assessment (BRITE)¿. The BRITE workshop discussed insights from cancer research, epigenetics, non-human and human risk assessment, since many of the state-of-the-art biomarkers being developed for humans deserve consideration for environmental applications and vice versa.
