Hierzu werden die Möglichkeiten und Grenzen der strafrechtlichen Vermögensabschöpfung bei unternehmensbezogen Straftaten, unter Einbeziehung der aktuellen Rechtssprechung und des Meinungstandes in der Literatur, analysiert. Auf Grundlage dieser Auswertung werden unter Abwägung der eingriffsintensiven Folgen der Bruttoabschöpfung bei unternehmensbezogen Straftaten präventive Ansätze zur Begrenzung des Instituts entwickelt.
