Ausgehend von der Darstellung, welche Formen von Drittanstellungen in der Praxis anzutreffen sind, widmet sich dieser Band der Vereinbarkeit der Drittanstellung mit der aktienrechtlichen Kompetenzordnung und den mit der Drittanstellung einhergehenden Interessenkonflikten sowie der Frage, ob die Drittanstellung zu Pflichtenkollisionen führen kann. Der Autor geht auch der Frage nach, ob und unter welchen Voraussetzungen eine Drittvergütung mit dem Aktienrecht vereinbar ist. Im Übrigen behandelt er ausgewählte Probleme der Drittanstellung, wie etwa die Frage, ob der Drittanstellung ein Arbeitsvertrag zugrunde liegen kann.

Doch welchen Anteil am wirtschaftlichen Erfolg genießen diejenigen, die für die Gestaltung eines Produktes verantwortlich sind? Während schöpferisch tätige Arbeitnehmer für patent- oder urheberrechtsschutzfähige Arbeitsergebnisse gesetzliche Sondervergütungsansprüche geltend machen können, geht das Recht an designschutzfähigen Arbeitsergebnissen regelmäßig sondervergütungsfrei auf den Arbeitgeber über. Der Band analysiert diese gegenwärtige vergütungsrechtliche Behandlung schöpferisch tätiger Arbeitnehmer im System des Immaterialgüterrechts und mündet in einem konkreten Gesetzesvorschlag zur Einführung eines Sondervergütungsanspruches im Designgesetz.

Der Wandel des Eigensicherungsrechts zur Eigensicherungspflicht steht im Mittelpunkt dieses Buches. Hierfür ist der Resilienzgedanke ein Einflussfaktor. Die Untersuchung lehnt sich an das Telekommunikationsrecht an. Vergleichsmaßstab und zugleich Anknüpfungspunkt sind die ersten Eigensicherungspflichten aus dem LuftVG. Ausgangshypothese ist, dass die Verfassung einen eigenverantwortlichen Menschen voraussetzt. Dennoch wird die Eigensicherungspflicht, da sie dem Menschen die Entscheidungsfreiheit darüber nimmt, wie er seiner Eigenverantwortung nachzukommen hat, als Grundrechtseingriff qualifiziert. Die Ausgestaltung der Eigensicherungspflicht stellt sich insofern als eine Frage der Schranken dar. Die Arbeit ist eingebettet in die Debatte um gestufte Sicherheitsverantwortung, Privatisierungsfolgen und Regulierungsrecht. Sie untersucht den Rechtsgrund für Eigensicherungspflichten. Im Ergebnis zeigt sich, dass Resilienzbestrebungen die Eigensicherungspflicht modifizieren.

Der Band konzentriert sich auf die Frage, wie groß die Mitwirkung der nicht beweisbelasteten Partei an der Wahrheitsfindung im Zivilprozess ist bzw. sein sollte. Diese Frage erörtert die Autorin aus deutscher und türkischer Sicht im Lichte der gesetzlichen Entwicklungen in beiden Ländern. Sie analysiert die im Hintergrund der neuen Regelungen stehenden Abwägungen beider Gesetzgeber im Bereich der Informationsbeschaffung bzw. Sachverhaltsaufklärung durch die Parteien und diskutiert diesbezügliche von ihnen eingeführte Rechtsinstrumente. Sind die aktuellen Mitwirkungspflichten der Parteien in beiden Ländern für einen befriedigenden Zivilprozess hinreichend oder wären jeweils erweiterte Mitwirkungspflichten wünschenswert?

Das völkergewohnheitsrechtliche Interventionsverbot ist seit jeher ein unverzichtbares Element des internationalen Friedenssicherungssystems. Trotz seiner unbestrittenen Wichtigkeit ist unklar, welche Handlungsweisen gegenwärtig von dem Verbot umfasst sind. Aufbauend auf eine umfassende Auswertung der Staatenpraxis seit 2011 untersucht die Autorin, unter welchen Voraussetzungen Regierungen und Oppositionsbewegungen in Bürgerkriegen völkerrechtsgemäß unterstützt werden dürfen. Angesichts der Schneise der Verwüstung, die sich seit Beginn des ¿Arabischen Frühlings" durch die betroffenen Länder erstreckt, hinterfragt die Autorin die kontemporäre rechtliche Relevanz des Interventionsverbots.

The goal is to summarise the studies on the transformations in the civil service systems in European and other countries, with a special focus on civil service in Poland.
