From her personal diary as an eleven-year-old in a Catholic girl's school, in which she chastises herself for the sin of wearing a bathing suit, through erudite analysis of the patriarchal structures on which most world communities stand, Elena GarcZs examines culture, history, economics, law, and religion as they apply to her native Colombia. In so doing, she promotes ideas which demolish the 'forced enclosure' of women in that society. Eighteen Colombian women, selected at random from many regions and ethnicities, and from up and down the socioeconomic ladder, tell life stories almost universally tragic, regardless of the wealth, education, age, or status derived from positions held by their husbands. Their experiences, in particular the ways in which family and institutions are used against them, illustrate the feminist theories around which GarcZs shapes her arguments. This book will be ideal for undergraduate students of Women's Studies, Latin American Studies, Religion, and Sociology. It will also appeal to scholars interested in the welfare and development of women.
Effigy examines the images of a capital defendant portrayed, by the defense attorneys and the prosecutor, during the guilt and penalty phases of capital trial, the trial tactics used to impart these images, and the consequences that result from the jury's attempt to reconcile contradictory images to place one in permanent record as a verdict. These images are starkly contrasted against the backdrop of a brutal murder in which the stereotypes of American fear are realized: Donta Page, the defendant, is an African-American male from a low-income segment of society while Peyton Tuthill, the victim, was a Caucasian female from a middle-income suburb. The prosecuting attorneys depict the defendant as a 'savage beast,' juxtaposing their image against that of a 'troubled youth' as Page is portrayed by the defense attorneys. Slowly and methodically developed as figures with diametrically opposed features, none of which overlap or congeal, both the images are portrayed as real (buttressed by the testimony of witnesses) rather than constructed. The jury is expected to render a verdict that accepts one and rejects the other: there is no middle ground.
Class Construction explores class, racial, and gender identity construction among white, working-class students. Delving into River City High School, Freie asks what happens to the adolescent children of working-class families when economic changes such as globalization and technological advancements have altered the face of working-class jobs. Mass consumerism, greater availability of college level education, lack of a cohesive class identity, and racial and religious politics all combine to create a new working-class identity for today's youth. Featuring interviews with the River City High School students, Class Construction aims to understand how class is conceptualized among American, working-class youths. The Laboring of Communication examines the transformation of work and of worker organizations in today's Information Society. The book focuses on how traditional trade unions and new worker associations growing out of social movements are coming together to address the crisis of organized labor. It concentrates on the creative responses of the technical and cultural workers in the mass media, telecommunications, and information technology industries. Concentrating on political economy, labor process, and feminist theory, it proceeds to offer several ways of thinking about communication workers and the nature of the society in which they work. Hegel's enduring importance lies in the fact that his philosophy sheds light on many contemporary problems; his conception of freedom enables us to reconcile many of the differences that divide liberalism and communitarianism. While liberalism tends to overemphasize the individual and devalue the community, communitarianism tends to do the reverse. One of his central aims is to integrate liberalism's concern for the political rights and interests of individuals within the framework of a community. He tries to reconcile the individual and community in a way that creates the proper mix of liberty and authority. One of Hegel's goals is to discover social structures that will allow individuals to escape the alienation that characterizes contemporary life. He sought a method of reconciling his contemporaries to the modern world by overcoming the things that split the self from the social world; that is, a place where people are at home in the social world. A sense of estrangement is all too common, even for those who enjoy more personal freedom and material abundance than ever thought possible. While Hegel is speaking directly to and about his contemporaries, their social world bears much in common with ours. Consequently, his attempt to reconcile philosophical and social contradictions can elucidate our own condition. While the modern world reflects important contributions, the advent of modern liberalism leads to excessive individualism that fragments social life, leaving individuals disconnected and adrift from meaningful social life. The major goal of Hegel's political philosophy is to reconcile the individual with his or her political community in a way that overcomes the alienation of modern life.
This book examines the history of the Fourth Amendment, which prohibits unreasonable search and seizure, and its interpretation by the Supreme Court. It concentrates on the changes in interpretation that have taken place after the Supreme Court, led by Chief Justice Earl Warren in 1961, decided in Mapp v. Ohio to apply the exclusionary rule, which makes illegally seized evidence inadmissible in court, to the actions of state governments. In The Evolution of the Fourth Amendment, Thomas N. McInnis demonstrates that prior to Mapp the Court relied on the warrant rule, which with limited exceptions emphasized the need to have a search warrant prior to a search or seizure. Due to the unhappiness that post-Warren Courts had with the application of the exclusionary rule, they reinterpreted the Fourth Amendment using the expansive language that the Warren Court had used in Fourth Amendment cases. In doing so, they broadened the government's powers to search and seize under the Fourth Amendment by developing new exceptions to the warrant rule, developing both the reasonableness approach and special needs test to the Fourth Amendment, limiting the expectations of privacy that citizens have, and narrowing those areas actually protected by the amendment. McInnis also examines how the Court has limited the effect of the exclusionary rule by reinterpreting when it needs to be applied and by creating new exceptions. The book ends by examining the emerging Fourth Amendment jurisprudence of the Roberts Court and assessing the future of the Fourth Amendment in a post-9/11 world.
One of the state's key features is its ability to oblige its citizens to risk their lives on its behalf by being sent into war. However, what is it about the state (or its equivalent) that makes this obligation justifiable? Justifying the Obligation to Die is the first monograph to explore systematically how this obligation has been justified. Using key texts from political philosophy and just war theory, it provides a critical survey of how this obligation has been justified and, using illustrations from Zionist thought and practice, demonstrates how the various arguments for the obligation have functioned. The obligation to risk one's life for the state is often presumed by theorists and practitioners who take the state for granted, but for the Zionists, a people without a state but in search of one and who have little history of state-based political thought, it became necessary to explain this obligation. As such, this book examines Zionism as a Jewish political theory, reading it alongside the tradition of Western political thought, and critiques how Zionist thought and practice sought to justify this obligation to risk one's life in war_what Michael Walzer termed 'the obligation to die.' Finally, turning to the political thought of Hannah Arendt, the author suggests how the obligation could become justifiable, although never entirely justified. For the obligation to become at all justifiable, the type of politics that the state enables must respect human diversity and individuality and restrict violence so that violence is not a continuation of politics.
Scholar and avid campaign watcher Christian P. Potholm brings to bear his enthusiasm for politics, and his intricate understanding of campaign strategy, in This Splendid Game: Maine Campaigns and Elections, 1940-2002. For each decade covered, Potholm briefly outlines all of Maine's U.S. Senate, U.S. House, and gubernatorial elections, then delves deeper into one campaign. He examines how Margaret Chase Smith became the first woman elected to the Senate, in 1948. He looks into which factors enabled the 'Muskie revolution,' beginning when Maine's long-in-power Republican party lost the governorship to the Democrat Ed Muskie in 1954, and cresting in the Democrat Ken Curtis's hard-fought gubernatorial re-election victory in 1970. He explores how the Republican counter-revolution took hold when Bill Cohen was elected to Congress in 1972, after having won many voters by walking about 600 miles across the state; and why in 1974 and 1994 Mainers chose Independent governors, respectively James Longley, Sr., and Angus King. And he examines how the Maine Yankee nuclear power plant survived the 1980 referendum on its possible shut-down. Throughout the book, Potholm focuses especially on the dynamics of candidates' and groups' use of polling and the media. This Splendid Game yields valuable insights into politics in Maine and the art of the political campaign.
Franco Ferrarotti turns his considerable erudition and insight to issues of theory and method in the human sciences, arguing that sociological investigations have been limited by their preoccupation with quantitative methods of investigation. Crucial social problems, from drug addiction to terrorism, can best be addressed by rediscovering autobiographical materials and the value of the individual. Ferrarotti hopes to lead sociologists away from overly reductionistic, technical measurement of their subjects_an approach that has increasingly been problematized by the natural sciences_toward an examination of the domain of lived experience using methods that are both interpretive and historical.
Marching against Gender Practice: Political Imaginings in the Basqueland begins with the question: why is it so problematic for the majority of people in the Basque town of Hondarribia to accept the broader participation of women in their annual military march known as the Alarde? To explain this dispute, this study examines local history as well as the history of this unique parade, but most importantly considers how gender practices were and are organized. The controversy to extend female involvement in the Alarde resulted in two positions between betikoak traditionalists, (Betiko Alardearen Aldekoak, ';Always the Town's Alarde'), and local ';feminists' (emakumealdekoak or Emakumeak JuanaMugarrietakoa, the Women of Mugarrietakoa, WJM), the former group wishing to preserve the ritual and the latter wanting to change it. These are not simply dichotomous stances but represent multiple levels of local identity through differing concepts of gender, history, and social experience. It will be shown throughout the Alarde's long history (1639-present) that it represents several periods of militarism from the town's defense in 1638 against French forces, Napoleonic resistance (1808-1813) to the Carlist Wars (1833-1840 and 1872-1876). The Alarde began as a religious procession and gradually incorporated more and more secular elements. In essence, by the end of the nineteenth century and beginning of the twentieth century, the Alarde became one of many ';Basque celebrations' (Euskal jaiak), tying it to Basque nationalism. Marching against Gender Practice centers on gender analyses of two opposing gender worldviews between the betikoak traditionalists and WJM feminists, but it aims at being applicable to gender theories in general, especially how gender may be cognized and what cognitive processes and cognitive systems may be included in the cognition of gender. By implication, it is asserted that collective imagination is not an immutable or static concept but may represent locality, regionalism, and nationalism as well as imbue concepts of communality, individuality, gender, harmony, historical narration, memory, social organization, and tradition. Commemorative, historical or re-enactment rituals like the Alarde of Hondarribia explain the duration of local identity, its transformation over time, and newer expressions of identity, which are continually being contested and reaffirmed through collective imagination.
Future Psychoanalysis: Toward a Psychology of the Human Subject focuses on the future of psychoanalysis considering its current critical condition. The informative theory of psychoanalysis has reached its limits, but its structural base offers a comprehensive theory, promising fruitful future psychoanalysis. It is a theory of the structural foundation of the intrapsychical core of the human subject. Since the human sciences are currently adopting the structural outlook in their fields of research, psychoanalysis could join the humanities as one of its fields, not just as a clinical profession that is parasitically linked to the more active idiographic fields of epistemology. Future Psychoanalysis introduces a structural theory of psychoanalysis to replace the demising informative theory and points to where future psychoanalysis will thrive.
Rome and the Spirit of Caesar, providing a fresh interpretation of Julius Caesar, is a thorough examination of Shakespeare's presentation of the final throes of republican Rome's political decay and demise and the rise of Caesarism. As in his previous studies of Shakespeare's plays, Blits, pursuing his distinctive approach, follows Caesar through, scene by scene, speech by speech, line by line, reaching his conclusions by closely examining Shakespeare's text. The so-called Islamic State (IS) that has swept into power in parts of Syria and Iraq presents an imminent danger to the global community with its capacity as an effective, ideologically motivated, and bloodthirsty fighting force, coupled with its expanding territorial reach, on the ground and online. The IS has taken on a quasi-state form that mixes modernity with ancient rites, and aggressively promotes sectarian violence and religious extremism with a decidedly apocalyptic bent. Too, it has introduced to the Middle East a new level of extremism and brutality, marked by volatile fluidity, with far-reaching, dangerously destabilizing effects on state and non-state actors, regionally and globally.This book offers insights into the nature of the IS and what the international community can do to combat it. In order to achieve this objective, the origins, intentions, leadership, capabilities, and operations of the IS are explored. The Islamic State's multifaceted efforts and effects in the region and beyond are described. Also, national, regional, and global strategies that are being pursued to address the new threat are examined. To this end, a range of recommendations are offered on specific steps that governmental, intergovernmental, and non-governmental bodies can take to counter the IS menace. Lastly, additional insights are presented relevant to combating the IS and undermining its potential future capabilities.
This book examines the judicial opinions and criminal justice policy impact of Justice John Paul Stevens, the U.S. Supreme Court's most prolific opinion author during his 35-year career on the nation's highest court. Although Justice Stevens, a Republican appointee of President Gerald Ford, had a professional reputation as a corporate antitrust law attorney, he immediately asserted himself as the Court's foremost advocate of prisoners' rights and Miranda rights when he arrived at the Court in 1975. In examining Justice Stevens's opinions on these topics as well as others, including capital punishment and right to counsel, the chapters of the book connect his prior experiences with the development of his views on rights in criminal justice. In particular, the book examines his relevant experiences as a law clerk to Justice Wiley Rutledge in the Supreme Court's 1947 term, a volunteer attorney handling criminal cases in Illinois, and a judge on the U.S. court of appeals to explore how these experiences shaped his understanding of the importance of rights in criminal justice. For many issues, such as those affecting imprisoned offenders, Justice Stevens was a strong defender of rights throughout his career. For other issues, such as capital punishment, there is evidence that he became increasingly protective of rights over the course of his Supreme Court career. The book also examines how Justice Stevens became increasingly important as a leading dissenter against the diminution of rights in criminal justice as the Supreme Court's composition became increasingly conservative in the 1980s and thereafter. Because of the nature and complexity of Justice Stevens's numerous and varied opinions over the course of his lengthy career, scholars find it difficult to characterize his judicial philosophy and impact with simple labels. Yet in the realm of criminal justice, close examination of his work reveals that he earned a reputation and an enduring legacy as an exceptionally important defender of constitutional rights.
During the first decade of this millennium Germany's largest ethnic minorityTurkish Germansbegan to enjoy a new cultural prominence in German literature, film, television and theater. While controversies around forced marriage and ';honor' killings have driven popular interest in the situation of Turkish-German women, popular culture has played a key role in diversifying portrayals of women and men of Turkish heritage. This book documents the significance of marriage in 21st-century Turkish-German culture, unpacking its implications not only for the cultural portrayals of those of Turkish background, but also for understandings of German identity. It sheds light on the interactions of gender, sexuality and ethnicity in contemporary Germany.This book explores four notions of marriage in popular culture: forced marriage; romantic marriage; intercultural marriage; and gay marriage. Over five chapters, the book shows that in popular culture marriage is conventionally portrayed as little more than a form of oppression for Turkish-German women and gay men. The state of Turkish matrimony is seen as characterized by coercion, lack of choice, familial duty and ';honor,' even violence. In German culture, by contrast, marriage stands for individual choice, love and equality. However, within comedy genres such as ';chick lit', ';ethno-sitcom' and wedding film, there have been attempts to challenge the monolithic power of these gender stereotypes. This study finds that, in grappling with the legacy of these stereotypes, these genres reveal a yearning within German popular culture for the very kinds of ';traditional' gender roles Turkish Germans are imagined to inhabit. The book provides a comprehensive account of the multiple ways in which the diverse portrayals of marriage shape views of Turkish Germans in popular culture, and are also revealing of the role of gender in contemporary Germany. It investigates some key genresautoethnography, chick lit, ethno-sitcom, wedding film, ';gay' Bildungsroman, documentary theaterwithin which questions of gender and cultural difference are ';framed'. In new and innovative close readings of literary, filmic, television and dramatic texts, the work reveals the broad significance of cultural portrayals of Turkish-German intimacy.
The year 2015 marks the 15th anniversary of St. Pope John Paul II's promulgation of Thomas More as Patron Saint of Statesmen and Politicians. Yet during these years no serious answer has been given by a community of scholars as to why More was named such. What were More's guiding principles of leadership and in what ways might they remain applicable? This collection of essays addresses these questions by investigating More through his writings, his political actions, and in recent artistic depictions.
From My Recent Past is a memoir written by Russian revolutionary Grigory Gershuni (18701908), the infamous mastermind behind the Combat Organization (CO) of the Socialist Revolutionary Party (SR). Grigory Gershuni envisioned himself a knight fighting the dragon of injustice, a believer in a Russian revolution that would sweep away an autocratic ';regime that made killers of its own children!' In his view, his personal mission was to cut off the head of that dragon, i.e. eliminate the cruelest, corrupt, and lawless agents of the repressive tsarist regime. Over the course of nine years (from 1902 to 1911), he engaged seventy-eight members of his Combat Organization to commit 263 terrorist acts, including the assassination of two government ministers, thirty-three governors-general, a vice-governor, as well as several admirals and generals.This book depicts his revolutionary activities, his arrest, and proceedings before a military tribunal, a death sentence verdict that was replaced at the last minute by a life sentence, and years of imprisonment in the Peter and Paul and Shlisselburg fortresses. It is presented here in English translation by Katya Vladimirov, with an introduction by Katya Vladimirov and an afterword by John P. Moran.
Over the last two decades or so, a number of developing countries have become important suppliers of manufactured goods. A good deal of these goods are produced under extremely poor working conditions, incompatible with the fundamental rights and freedoms. However, WTO rules do not allow restrictions on imports of such goods, and the ILO hardly ever sanctions violations of international labor standards. On the one hand, this leaves exporting countries free to compromise on labor protection in order to enhance their competitiveness on foreign markets. On the other hand, importing countries are obliged to keep their markets open for goods produced under substandard labor conditions. This gives rise to the question of whether the rules of the multilateral trading system should be linked to international labor standards. This study argues that there are two trade-related reasons for establishing such a link.The first one is commonly referred to as social dumping. GATT rules enshrine the principles that should govern international trade: fairness and responsibility. These principles should also apply where trade meets labor protection. Exporting goods made under substandard labor conditions is unfair and distorts trade. It would therefore be consistent to make social dumping actionable. The other reason concerns the responsibility of importing countries. Increased imports of goods produced under substandard labor conditions are an incentive for the exporting country to produce more goods under the same labor conditions, and ship them to the same importing country. This results in a proliferation of violations of labor standards, for which the importing country shares the responsibility. There is a need to adopt a link between trade and labor standards enabling the importing country to cap imports in order to escape the blame.
Gender-Based Perspectives on Batterer Programs responds to the intense debate about the approach and effectiveness of batterer programs, especially in light of the ';evidence-based practice' movement. But it does so through a collection of 24 interviews with batterer program founders and leaders who have been working in the field for 25 to 35 years. In the process, it answers many of the misconceptions and misrepresentations of batterer programs, and highlights their contributions and development. It also offers recommendations to researchers and the field in general that would help strengthen the work overall. More specifically, the book is a follow-up to the author's research-oriented book, The Future of Batterer Programs: Reassessing Evidence-Based Practice (Northeastern University Press, 2012). That book critically reviewed the research on batterer programs in light of the demand for documentation of program effectiveness and documented the effective role of batterer programs in an intervention system. It also exposed the need for ';evidence-based practice' research to include the feedback, interpretations, and critique of practitioners who have their own ';evidence' to contribute. In Gender-Based Perspectives on Batterer Programs, a summarizing introduction and conclusion on leadership frame the set of leader interviews. The collection of interviews represents an archive of the experience and wisdom of long-term workers in the fieldmany of whom are on the verge of retirement. This ';database' should help researchers develop more meaningful studies, and ground research results in actualities of the work. Ideally, the interviews will also help practitioners realize their commonalities and better represent themselves to their critics and public in general.
Water covers some 75% of the earth's surface, while land covers 25%, approximately. Yet the former accounts for less than 1% of world GDP, the latter 99% plus. Part of the reason for this imbalance is that there are more people located on land than water. But a more important explanation is that while land is privately owned, water is unowned (with the exception of a few small lakes and ponds), or governmentally owned (rivers, large lakes). This gives rise to the tragedy of the commons: when something is unowned, people have less of an incentive to care for it, preserve it, and protect it, than when they own it. As a result we have oil spills, depletion of fish stocks, threatened extinction of some species (e.g. whales), shark attacks, polluted and dried-up rivers, misallocated water, unsafe boating, piracy, and other indices of economic disarray which, if they had occurred on the land, would have been more easily identified as the result of the tragedy of the commons and/or government ownership and mismanagement. The purpose of this book is to make the case for privatization of all bodies of water, without exception. In the tragic example of the Soviet Union, the 97% of the land owned by the state accounted for 75% of the crops. On the 3% of the land privately owned, 25% of the crops were grown. The obvious mandate requires that we privatize the land, and prosper. The present volume applies this lesson, in detail, to bodies of water.
This book provides a juridical, sociopolitical history of the evolution of the 1994 Rwandan genocide. Over one million citizens were massacred in less than 100 days via a highly organized, efficiently executed genocide throughout the tiny country of Rwanda. While genocide is not a unique phenomenon in modern times, a genocide like Rwanda's is unique. Unlike most genocides, wherein a government plans and executes mass murder of a targeted portion of its population, asking merely that the majority population look the other way, or at most, provide no harbor to the targeted population (ex: Germany), the Rwandan government relied heavily on the civilian population to not only politically support, but actively engage in the acts of genocide committed over the 100 days throughout the spring of 1994. This book seeks to understand why and how the Rwandan genocide occurred. It analyzes the colonial roots of modern Rwandan government and the development of the political ';state of exception' created in Rwanda that ultimately allowed the sovereign to dehumanize the minority Tutsi population and execute the most efficient genocide in modern history.
Drawing on recently declassified Soviet archival sources, this book sheds new light on how the division of Europe came about in the aftermath of World War II. The book contravenes the notion that a neutral zone of states, including Germany, could have been set up between East and West. Justice as Right Actions presents an original theory of justice anchored in the analytical philosophical tradition. In contrast to many contemporary approaches, the theory provides normative guidance, rather than focusing solely on political structures and institutions, as the question of justice is seen to comprise both a moral inquiry concerned with questions of good and bad, right and wrong, and a political inquiry, concerned with the nature of the polity and how individuals relate to it. Presenting a relational account of justice, rather than a distributive account the latter, so much more prevalent in current studies communications are seen as the key to the theory, both in the substantive sense as a discursive method of resolving disputes, as well as instrumentally, in the transmission of concepts, especially values through time.Rule-oriented in approach, justice as right actions attempts to be value-neutral, acknowledging, however, an underlying thin theory of the good, including concepts of rationality, autonomous moral agency, equal concern and respect for others, as well as plurality of values. Its political context is liberalism, with components of negative liberty and equality of concern and respect, while underscoring as well, the concepts of tolerance and social diversity.In this study, the original theory of Justice as Right Actions is also contrasted with and situated among contemporary accounts of justice, including the most important theoretical works on the topic in the past half-century. Thus, the study also serves as a valuable review and critique of such major contemporary accounts of justice.
This book examines the political and economic philosophy of Chief Jeremiah Oyeniyi Obafemi Awolowo and his concepts of democratic socialism (Liberal Democratic Socialism). Organ Donation in Japan: A Medical Anthropological Study by Maria-Keiko Yasuoka reveals insight into Japan as the country with the most severe organ shortages and the lowest numbers of organ donations among medically advanced countries. The history of organ transplantation in Japan is a unique and troubled one. Many academic hypotheses such as cultural barriers, the Japanese concept of the dead body, traditional beliefs, and so on have been advanced to explain the situation. However, little research has yet revealed the truth behind the world of Japanese organ transplantation. Yasuoka conducts direct interview research with Japanese ';concerned parties' in regards to organ transplantation (including transplant surgeons, recipients, and donor families). In this book, she analyzes their narrative responses, considering their distinctive ideas, interpretations, and dilemmas, and sheds light on the real reasons behind the issues. Organ Donation in Japan is the first book to delve into the challenging and taboo Japanese concepts of life and death surrounding organ transplantation by thoroughly presenting and investigating the narratives of concerned parties.
Persuasive Aesthetic Ecocritical Praxis continues Patrick D. Murphys focus on transversal ecocritical praxis by considering literature and cinema in terms of the persuasive force of aesthetic activity and whether or not artistic production and its criticism can be considered forms of activism. Murphy argues that literature and other forms of aesthetic production hold out the promise of being able to move some individuals deeply through both affective and intellectual engagement in ways that facilitate ideological reflection. To analyze aesthetic production ecocritically requires a transversal orientation in order to work continuously at accommodating a vast array of often seemingly disparate perspectives, disciplines, and contextual information, as well as the ever changing thematic, plot, setting, and contextual elements of the aesthetic works under consideration and the responses of changing audiences through time and across cultures. Murphy demonstrates this approach through presenting theories of transversality and applying them with attention to issues of propaganda, agitation, and persuasion, both in terms of artistic production and the criticism of such production. He also brings an ecofeminist orientation to the fore with particular attention to the gendered economic aspects of environmental issues in an age of land grabs and plantation economies. Along the way he treats a wide range of literary works, films and miniseries. In American literature he discusses realist and science fiction works, from Susan Fenimore Coopers Rural Hours to Paolo Bacigalupis The Windup Girl, Barbara Kingsolvers Flight Behavior to Kim Stanley Robinsons 2312, and Ana Castillos So Far from God to Leslie Marmon Silkos Gardens in the Dunes.
