E é mesmo, porque retrata momentos da história do Direito Penal, quando ele ainda não merecia maior atenção, quando as coisas aconteciam pelo impulso, desejo e ação dos mais fortes. Uma época na qual ele apenas começava a ser percebido como uma necessidade para os homens. Quer dizer: para alguns homens... para aqueles que tinham o poder de decidir sobre o destino de si mesmos e dos "inferiores". Quando a punição passou a receber atenção das pessoas de luzes e um nome científico, o conhecimento começou a ser sistematizado e os institutos delineados, permitindo seu estudo. Aqui, busco apresentar um resumo das teorias que justificam e dão finalidade às penas criminais, criticadas desde que foram inventadas por poucos e para muitos.
