What is the relationship between culture and human rights? Can the idea of cultural rights, which are predicated on the distinctiveness and exclusivity of a communitya (TM)s beliefs and traditions, be compatible with the concept of human rights, which are universal and a ~inherenta (TM) to all human beings? If we accept such compatibility, what is the actual content of cultural rights? Who are their beneficiaries: individuals, or peoples or groups as collective entities? And what precise obligations do cultural rights pose upon states or other actors in international law, or for the international community as a whole? International instruments on the protection of human rights do not provide self-evident answers to these questions. This book seeks to analyse these dilemmas and to assess the impact that they are having on international law and the development of a coherent category of cultural human rights.

In 1981, the European and World Values surveys started the empirical investigation of cultural values on a global scale. This volume builds upon the findings of these surveys and analyzes value change in a number of key countries around the globe. The authors track value change and stability in their respective countries during the last decade (the last two decades where data are available) of the 20th century. All authors have been actively involved in value surveys and have a great deal of expertise in countries that they write on. Thus, the volume is a valuable complement to studies that deal with the topic from a global perspective without providing any detail about individual societies. This collection offers an overview of the issues involved concerning the interface between human rights and intellectual property rights (IPRs). It makes clear that two schools of thought have developed. The first school maintains that human rights and IPRs are in fundamental conflict. Strong protection of IP is incompatible with human rights obligations. Thus, for resolving the conflict between the two, it is suggested that human rights should always prevail over IPRs. Whereas the second school of thought asserts that human rights and IPRs pursue the same aim; that is to define the appropriate scope of private monopoly power to create incentives for authors and inventors, while ensuring that the public has adequate access to the fruits of their efforts. Accordingly, they argue, human rights and IP are compatible. However, what is needed is to strike a balance between the provision of incentives to innovate and public access to products of that innovation. This collection explores this balance and the extent to which human rights standards can influence the interpretation of IP norms, for example in defining the scope of IPRs. The discussion on the relationship of human rights and IPRs is an ongoing one; this volume makes a valuable contribution to the debate and will further stimulate the interest to explore and address these complex and challenging issues. Internationally operating nongovernmental organisations, NGOs, are increasingly involved in international politics and policy making. In many respects their involvement resembles activities and policies that, until recently, were typical of traditional national authorities. This book is about the reasons for which NGOs can and the reasons for which NGOs cannot be considered as rightful participants in international governance. It tries to deliver rationally defensible starting points for the discussion and the assessment of claims for the legitimacy of their organizations and activities. The book focuses on the question: What conditions must ideally be met for an organization to be called truthfully legitimate, be it or be it not as a matter of fact perceived as legitimate by the public? This does not mean that empirically descriptive questions are left aside. Practical feasibility is important even to a thoroughly normative conception of legitimacy. For that reason and for heuristic purposes, large parts of this book are dedicated to the ways in which NGOs and stakeholders perceive NGO legitimacy.
