Drawing on interviews with twenty-two same-sex, married couples, this book argues that the Catholic tradition should expand its definition of sacramental marriage to include same-sex couples. Stories from these couples illustrate that the church would benefit from a deeper commitment to practices of radical hospitality and sanctuary.

This edited collection examines decision-making in the EU and its constitutional structure through the lens of the separation of powers. This focus reveals how a strong executive represents a single source of public power, which is not as sufficiently counterbalanced. It explores three fields: economic and monetary union, migration, and trade. Drawing on expertise from across those sectors, with a strong conceptual thread linking all the contributions, this important work illustrates how different branches of government co-determine each others' powers.
This open access book collects 11 reimagined judgments from the UK and challenges anthropocentrism in legal decision-making across a range of legal areas. It draws from a range of Earth law approaches including rights of nature, animal rights, environmental human rights, well-being of future generations, ecocide, and reinterpretations of existing legal principles. There is an urgent need to transform our legal institutions and cultures to foster healthier relationships between people and planet. The book explores how relationships between people, place, and the more-than-human world are produced, transformed, and destroyed through law, the limits of current law and the potential for positive transformation. A paradigm shift towards planetary, ecological and multispecies approaches offers possibilities for envisioning what the future of legal decision-making could look like. Beyond the judgments, the book critically reflects on the developing field of Earth law and its potential for reshaping legal reasoning in the UK and beyond. It also offers possibilities for the future of Earth law from scholarly, educational, and policy perspectives within legal practice, training and education. The book is a must read for scholars, students, legal practitioners and activists questioning the role of law and courts as mechanisms for change. The ebook editions of this book are available open access under a CC BY-NC-ND 4.0 licence on bloomsburycollections.com.
This book engages with some of Stephen A Smith's most significant arguments, illustrating that he was a towering figure in the field of private law, with little of the field not impacted by his scholarship. The contributors explore Professor Smith's most controversial thinking on private law. Interrogating questions of contract law, remedies, unjust enrichment, comparative law, and the legal theory underlying these fields, this is an important publication in the field.
The private law regulates life; this is self-evident, but how does it regulate death? This edited collection explores this question. Life and death are the beginning and end of the legal person: the instigator and terminator of rights, interests, and obligations. They are also the nominal separator of particular fields of law (medical law from succession law, for example). As such they act as fault lines that can test the limit of private law principles and norms. This book explores what life and death tell us about private law and what private law can tell us about the meaning and value of life and death.
This first book dedicated exclusively to the remedy of punitive damages combines empirical, historical and doctrinal analysis to illustrate the practical operation of the remedy, assessing its appropriateness. In part one, the author explores the law and its normative underpinnings. The second part provides an empirical survey of nearly 600 decisions delivered by courts at first instance and on appeal between 1964 and 2020 in England and Wales. The final part examines the main limitations on the availability of punitive damages in light of the normative basis of the remedy.
How does the EU legal structure impact on its relationship with third countries within its proximity? This original book explores this question, following three related lines of inquiry. Firstly, it examines similarities and differences between EU internal and external integration, looking at both EU membership and neighbourhood law. Secondly, it looks at the legal techniques relied upon to extend the EU's legal space. And thirdly, it sheds light on the different political covenants underlying legal relations in the wider European legal space. The book explains how EU neighbourhood law entails a reconfiguration of how sovereignty is exercised both in the EU and in third countries participating in the extended EU legal space.
With essays from the most important voices in the field, this is a seminal text on the influence of Marise Cremona on EU external relations law.How powerful are EU external relations? For a long time, the law in this field was seen merely as an adjunct to constitutional law and the law of internal markets. However, in the last 20 years it has become a key tenet of the European Union, as globalisation and cross-border challenges have taken hold. Few have done more to shape the field's evolution than Marise Cremona, and this collection pays tribute to her immense contribution. In addition to assessing it power, it explores the role both the EU institutions and indeed EU people across borders. This is a compelling exploration of a fascinating subject.
