Universal jurisdiction is an established principle in International law. The evolution of legal jurisprudence on fighting impunity developed a basis for the global prosecution of the perpetrators of heinous crimes. Nevertheless, international legal practice disclosed a notable gap concerning the interpretation and application of universal jurisdiction since the diversity of nations' judicial regimes and cultural backgrounds prevented the creation of a unified global understanding of universal jurisdiction. It is a problematic status that frustrated universal endeavours to prosecute serious criminals and achieve justice. This gap is glaring particularly in the Western judicial practices regarding atrocities committed within Arab territories since 2011.In this aspect, this book studies the Arab jurisprudence on universal jurisdiction to conclude its main feature and compares it with the features of the Western interpretation of this principle. The comparison contributes to determining the gap between these identified legal systems and then concluding the chief landmarks of the legal vacuum created between them. It reviews the main causes of this vacuum and its dire consequences on international justice. Through this methodology, the book suggests a multi-dimensional solution to the dilemma which settles the legal disputes aroused by the diversity in understanding universal jurisdiction. It manifests a major contribution to legal knowledge because it bridges a crucial gap concerning universal jurisdiction.
