Im Fokus der Betrachtung steht dabei die Funktionsteilung zwischen dem Insolvenzverwalter, den Gesellschaftsorganen und den Gesellschaftern. In diesem Kontext wurden insbesondere die Bilanzierungs- sowie die Steuererklärungspflichten bei Insolvenz der Personengesellschaft untersucht. In Folge dessen wird der Umfang der Bilanzierungspflicht, sowie die Zuständigkeit für die Aufstellung der Gesamthands-, Ergänzungs- und Sonderbilanz beleuchtet.
