Um möglichen Haftungsansprüchen vorzubeugen, muss die Frage geklärt werden, wer bei Insolvenz über das Vermögen einer Personengesellschaft die steuerlichen Mitwirkungspflichten zu erfüllen hat. Im Fokus der Betrachtung steht dabei die Funktionsteilung zwischen dem Insolvenzverwalter, den Gesellschaftsorganen und den Gesellschaftern. In diesem Kontext wurden insbesondere die Bilanzierungs- sowie die Steuererklärungspflichten bei Insolvenz der Personengesellschaft untersucht. In Folge dessen wird der Umfang der Bilanzierungspflicht, sowie die Zuständigkeit für die Aufstellung der Gesamthands-, Ergänzungs- und Sonderbilanz beleuchtet. Hinsichtlich der Steuererklärungspflicht greift die Arbeit u. a. die teilweise in der Literatur geäußerte Kritik an der finanzgerichtlichen Rechtsprechung zur gesonderten und einheitlichen Gewinnfeststellungserklärung bei Insolvenz der Personengesellschaft auf, zeichnet die Entwicklung nach und erörtert ausführlich die Argumentationsstränge.
