Der Beschluss ist als Verfahren kollektiver Willensbildung im Privatrecht durchweg etabliert. Anders als die einzelne Willenserklärung oder der Vertrag hat er allerdings keine allgemeine Regelung erfahren. Der Autor weist nach, dass für privatrechtliche Beschlüsse stets die gleichen Funktionsvoraussetzungen gelten und diese daher auf einer einheitlichen Dogmatik basieren. Aufbauend hierauf arbeitet er diese Dogmatik heraus und ordnet die Entfaltung privaten Handelns in Beschlussform in generalisierender Weise. In der Gesamtschau entsteht ein Koordinatensystem, das als eine allgemeine Beschlusslehre ein strukturiertes Navigieren durch die Entscheidungsfindung im Kollektiv ermöglicht.

Afrikanische Staaten hatten als Folgen der globalen COVID-19-Pandemie signifikante Einbrüche von ausländischen Direktinvestitionen zu verzeichnen. Zugleich offenbarte die Pandemie neue Wege chinesischer Einflussnahme und Wirtschaftsdiplomatie auf dem afrikanischen Kontinent. Während westliche Staaten zunehmend das Bild eines "systemischen Rivalen" zeichnen, erscheinen bilaterale Investitionsschutzabkommen (BITs) zwischen China und Staaten Afrikas (China-Afrika-BITs) aus afrikanischer Perspektive legitimer und entwicklungsfreundlicher als solche mit Staaten des Globalen Nordens. Dagegen impliziert das wirtschaftliche Ungleichgewicht der Akteure "neokoloniale" Tendenzen. China-Afrika-BITs ordnen sich entsprechend in die Debatten um globale Machtverlagerungen und die darin vermutete normative Neuausrichtung der globalen Wirtschaftsordnung ein.

Die Beihilfenkontrolle und die unionale Kompetenzverteilung haben sich seit der Gründung der EWG kontinuierlich fortentwickelt - und damit auch das Verhältnis beider Elemente zueinander. Untersucht man die Rechtsprechungsentwicklung seit 1958, zeigt sich, dass es dem EuGH nicht allein um ein möglichst weitreichendes Beihilfenrecht geht: Vor allem in souveränitätssensiblen Bereichen wie dem Steuerrecht und dem Sicherheitssektor nimmt der EuGH zunehmend Rücksicht auf die Gestaltungsräume der Mitgliedstaaten. Dass dennoch oft der Eindruck einer ausgreifenden Beihilfenkontrolle besteht, liegt nicht an der Rechtsauslegung, sondern an der faktisch gewachsenen Bedeutung des Beihilfenrechts. Um im dynamischen Unionsrecht einen Ausgleich zwischen dem Binnenmarktschutz und den nationalen Kompetenzen zu erzielen, sollten in Zukunft die primärrechtlichen Kompetenzgrenzen in der Beihilfenkontrolle Niederschlag finden.

Anhand von Archiv- und zeitgenössischen Literaturquellen analysiert Nils Hauser die nicht eindeutige Aufgabenstellung der Kriminalpolizei zwischen Justiz und Polizei. Nach einem rechtshistorischen Überblick über die Entstehung von Polizei und Kriminalpolizei wendet er sich den (kriminal-)polizeilichen Rechtsgrundlagen zu. Sodann untersucht er den Aufbau und die personelle Zusammensetzung der Berliner Kriminalpolizei in den Jahren 1925 bis 1937 und insbesondere die personellen Veränderungen durch "Preußenschlag" und "Machtergreifung". Er betrachtet die sich wandelnde Kriminalpolizeipraxis, insbesondere die Verfolgung von "Berufsverbrechern", "Asozialen" und Juden sowie die Entstehung einer polizeilichen Justiz. Abschließend fügt Nils Hauser diese drei Teile in einem Überblick über die Wechselwirkungen zwischen Polizeirecht, Strafrecht und Kriminalpolizeipraxis zu einem Ganzen zusammen.

Dieser zunehmenden Begegnung und Verschränkung von Umweltrecht und Finanzmarktrecht widmet sich Philipp Kleiner. Er untersucht ihre völkerrechtlichen Grundlagen, die sich etwa im Pariser Übereinkommen finden, ebenso wie die maßgeblichen europäischen Rechtsakte, wozu die Taxonomie- und Offenlegungs-Verordnung sowie der Entwurf eines EU Green Bond Standards zählen. In ihnen erkennt er die Ausprägung eines neuen Teilrechtsgebiets: des Umweltfinanzmarktrechts. Eine rechtsvergleichende Perspektive ermöglicht zudem einen Blick auf den Stand nachhaltiger Finanzmarktregulierung weltweit.

Ist das Patentrecht wirklich "wertneutral" oder gar "ethisch blind"? Die Praxis des Patentrechts wird von einem ungebrochenen Fortschrittsoptimismus getragen. Das hohe Maß an Technik- und Innovationsgläubigkeit lässt traditionell wenig Raum für eine tiefergehende Reflexion außerrechtlicher Wirkdimensionen des Patentsystems. Es stellt sich jedoch die Frage, ob Innovationsförderung ohne ein Mindestmaß an gesellschaftlicher Innovationsverantwortung überhaupt ein sinnvolles Ziel sein kann. Ein so facettenreiches Forschungsthema wie "Human Enhancements" eignet sich hervorragend dazu, um die Funktionen und Wirkungen des Patentschutzes zu veranschaulichen. An die Stelle eines allgemeinen Verweises auf "ethisch umstrittene Forschungsfelder" treten konkrete Beispiele. Die gewonnenen Erkenntnisse können wiederum in den interdisziplinären Gesamtdiskurs einfließen, der die biotechnische Selbstgestaltung des Menschen als Teil und Folge der modernen Gesellschaft und ihrer Charakteristika betrachtet. Die Arbeit wurde mit dem Innovationspreis 2023 der Humboldt-Universität zu Berlin und als beste Dissertation im Zivilrecht mit dem Promotionspreis 2023 der Juristischen Fakultät der Humboldt-Universität zu Berlin ausgezeichnet.

Das normierte Kaufrecht ist für die Unternehmenskaufpraxis weitgehend irrelevant. Stattdessen hat sie eigene, umfangreiche und in sich weitestgehend geschlossene Verträge entwickelt. Diese Vertragswerke sind wissenschaftlich unterbelichtet; selbst Kennern gilt die Unternehmenskaufpraxis als "Geheimwissenschaft". Die Untersuchung will das gelebte Unternehmenskaufrecht wieder stärker in den rechtswissenschaftlichen Diskurs integrieren und zeigt, dass Unternehmenskaufverträge ein äußerst reizvoller Untersuchungsgegenstand sind: Wie erfüllt das Privatrecht seine Unterstützungsfunktion bei Verträgen, die sich bewusst von Teilen des dispositiven Rechts abwenden? Welche Grenzen setzt das Bürgerliche Recht dem Gestaltungswillen der Kautelarpraxis, obschon viele Begründungsmuster für zwingende Vorschriften auf Unternehmenskaufverträge nicht passen? Und welchen (mittelbaren) Einfluss übt das Gesellschaftsrecht auf die Transaktionspraxis aus? Die Arbeit sucht Antworten auf diese grundsätzlichen Fragen und leistet damit einen Beitrag zu einer besseren wissenschaftlichen Erfassung der Kautelarpraxis insgesamt.

Staaten versuchen seit jeher, ihre Interessen durch nationales Recht auch außerhalb des eigenen Staatsgebiets durchzusetzen. Blocking Statutes wiederum werden eingesetzt, um die Wirkungen solcher extraterritorialen Jurisdiktion auf dem eigenen Staatsgebiet möglichst gering zu halten. Parallel zu einem vermehrten Erlass extraterritorial geltenden Rechts entwickeln sich auch Blocking Statutes zu einem immer beliebteren rechtlichen und politischen Instrument. Angesichts dieser steigenden Relevanz untersucht Marcel Gernert rechtsvergleichend Wirkungen und Folgen von Blocking Statutes und unternimmt eine Bewertung dahingehend, ob diese Gesetze ihre Ziele erreichen können oder über Symbolik nicht hinausgehen. Neben alternativen Reaktionsmöglichkeiten nimmt er auch die negativen Auswirkungen und Konfliktsituationen für die privaten Adressaten solcher Gesetze in den Blick und bezieht sie in die Gesamtbewertung ein.

Este libro, principalmente metodológico, aborda la implementación de diferentes técnicas de prospección arqueológica y el uso de distintos dispositivos capaces de generar nuevos datos en investigaciones multidisciplinares. Además, lejos de discutir la revisión bibliográfica y metodológica de los trabajos realizados hasta el momento, este trabajo pretende mejorar y complementar los estudios anteriores así como mostrar los diferentes tipos de técnicas y metodologías utilizadas en nuestra propia investigación, enfocadas principalmente a lograr una correcta geoposición del sitio arqueológico sumergido. Para ello se han intervenido en diferentes cuevas sumergidas de la costa de Barcelona y de la isla de Mallorca. Sin duda, esto nos ha permitido valorar su grado de rendimiento y utilidad, el tipo de sinergias necesarias para ello y la metodología más adecuada en cada momento. De esta forma, se ha podido generar una progresión efectiva de los principales conocimientos y soluciones técnicas disponibles actualmente. Además, se sugieren una serie de recomendaciones procedimentales dentro de un protocolo de actuación metodológico específico, confiable, riguroso y seguro. Por un lado, la intención final ha sido extraer conclusiones que permitan valorar los mejores métodos, técnicas, modos y maneras de trabajar en cada caso concreto al que nos podamos enfrentar al realizar una actividad arqueológica en una cueva kárstica sumergida. Por otro lado, y debido a los nuevos datos aportados en esta investigación, se han formulado nuevas hipótesis arqueológicas sobre la usabilidad de estas cuevas en la antigüedad, complementando así los estudios previos al respecto para cada yacimiento arqueológico y paleontológico analizado.

En septiembre de 2019 una DANA (Depresión Aisladas en Niveles Altos) que entraba por el noreste impactó severamente España y en especial la zona del Levante. Una de las áreas más afectadas fue la costa del Mar Menor y La Manga donde se encuentra la zona de estudio. Las DANA son fenómenos atmosféricos generados por el aislamiento del chorro polar o subtropical. Las cuales generan tormentas estables que suelen provocar lluvias torrenciales, así como una subida del nivel del mar debido a las marejadas ciclónicas. Para saber cómo afectó este fenómeno espacialmente en la zona se han analizado imágenes del sensor Sentinel 2A, generando mapas de usos del suelo a través de diferentes métodos de clasificación supervisada con el programa ENVI, utilizando como base para ello tanto Endmembers de curvas espectrales como Regions Of Interest abarcando varios píxeles de distintas coberturas homogéneas, las cuales son seleccionadas a través de la interpretación visual con el apoyo adicional de Google Earth Maps y documentación previa. Tras la clasificación y selección del método más efectivo, se realizó una comparación y estudio de las imágenes, obteniéndose tres mapas a partir de las imágenes de satélite de antes, durante y después de la DANA. Se obtuvieron las distintas zonas afectadas y las consecuencias que hubo, como inundaciones debido a riadas en el interior y pérdidas de zonas de playa en la costa. Además de las posibles causas antrópicas como la impermeabilización del suelo, encauzamiento de las ramblas y la mala gestión. Estas causas sumadas a las singularidades atmosféricas, obtenemos por qué fue tan dañina esta DANA.

The spreading antibiotic resistance of bacteria is one of the most important challenges of modern medicine, and a search for methods that could replace conventional treatments of bacterial infections is urgently needed. Bacteriophage therapy is considered one of the most important alternatives to commonly applied antibacterial strategies.This Special Issue, titled "Bacteriophage Therapy: Recent Developments and Applications of a Renaissance Weapon", collected eleven articles focused on different aspects of phage therapy. It includes five original articles, two case studies, and four reviews presenting research on the application of phages against pathogens posing a serious threat to human health, such as Salmonella enterica, Pseudomonas aeruginosa, Vibrio cholerae, and Staphylococcus aureus. The published articles also relate to the practical aspects of phage application, such as the development of modern phage carriers or the employment of mathematical tools for predicting bacteriophage features and their antibacterial potential. The Laguna de Santa Rosa, located in the Russian River watershed in Sonoma County, CA, is an expansive freshwater wetland complex that hosts a rich diversity of plant and wildlife species, many of which are federally or state listed as threatened, endangered, or species of special concern. The Laguna is also home to a thriving agricultural community that depends on the land for its livelihood. Over the past 200 years, modifications to the Laguna and its surrounding landscape have degraded habitat conditions for both wildlife and people. To help improve the Laguna ecosystem, the California Department of Fish and Wildlife and Sonoma Water funded the Laguna-Mark West Creek Watershed Master Restoration Planning Project. The overall goal of this report is to develop a plan that supports ecosystem services in the Laguna-through the restoration and enhancement of landscape processes that form and sustain habitats and improve water quality-while considering flood management issues and the productivity of agricultural lands. The first step in the Planning Project was developing a long-term Resilient Landscape Vision for the Laguna, which is detailed in this report. The Vision highlights opportunities for multi-benefit habitat restoration and land management within the Laguna's 100-year floodplain. This Vision will be used to build the Restoration Plan, which will provide restoration targets and restoration project concepts that can lead to longterm ecosystem improvement.
