This book presents a new window on the legal system of Ancient Israel. Building on the understanding that Israel was a society where writing was the medium for some forms of discourse but not others, where written texts were performed orally and rewritten from oral performances, Robert D. Miller II, OFS, examines law and jurisprudence in this oral-and-literate world. Using Iceland as an ethnographic analogy, Miller shows how law was practiced, performed, and transmitted; the way written artifacts of the law fit into oral performance and transmission; and the relationship of the detritus of law that survives in the Hebrew Bible, both Torah and Proverbs, to that earlier social world.

In "Notes from OHO Disability Hearings", Dr. Alexandre Todorov draws on his own 30 years' experience as a Medical Expert in over 4,000 OHO Disability cases to help attorneys and non-attorneys develop more compelling, stronger Social Security Office of Hearing Operations (OHO) disability cases for their clients. "Notes from OHO Disability Hearings" gives the necessary legal and medical knowledge so these representatives can successfully represent claimants at the hearings."Notes from OHO Disability Hearings" first presents the rules and regulations governing the OHO hearing process. The second section is a guide to the Listing of Impairments which details the medical criteria applicants must meet to receive disability. Vignettes from actual cases act serve as concrete examples of the disability severity required to grant relief to a claimant and each concludes with an assessment of the case and the rationale of the judge's decision.Based on Dr. Todorov's professional experience as a medical expert, it is his contention that better mining of medical records will nearly double the approval rate of disability applications. The goal of the book is to help representatives better analyze the medical record and better present the facts to the Administrative Law Judge (ALJ).

  • - What Place for Free Movement in National Family Law?
    av Olga Ceran
    1 421,-

Cross-border child relocation cases are among the most difficult issues in family law. As they engage free-movement rights-- the foundation of European Union law-- there is an increasing interest among scholars and practitioners alike in the influence of EU law on child relocation. However, considering the EU's scope of competence and the limited jurisprudence of the Court of Justice on such family matters, many questions regarding the reach of EU law have remained open. This book is the first monograph to investigate Europeanisation of cross-border child relocation law. What is the scope and nature of EU law's influence, both current and prospective? What are its impacts on national law? Cross-Border Child Relocation in the EU analyses the European legal framework of child relocation and potential harmonisation of the field. Using case law from Germany, Poland, England and Wales, it then qualitatively examines the processes of adaptation of national child relocation law to EU law. The book outlines the limits of EU law's pressures, but also conceptualises its influence from a constructivist perspective.

This unique collection explores the complex issue of vigilantism, how it is represented in popular culture, and what is its impact on behavior and the implications for the rule of law. The book is a transnational investigation across a range of eleven different jurisdictions, including accounts of the Anglophone world (Australia, Britain, Canada, and the United States), European experiences (Germany, Greece, Italy, Poland, and Portugal), and South American jurisdictions (Argentina and Brazil). The essays, written by prominent international scholars in law, sociology, criminology, and media studies, present data, historical and recent examples of vigilantism; examine the national Laws and jurisprudence; and focus on the broad theme of vigilante justice in popular culture (literature, films, television). Vigilante Justice in Society and Popular Culture sheds light on this topic offering a detailed look beyond the Anglophone world. This collection will enrich the debate by adding the opportunity for comparison which has been largely lacking in scholarly debate. As such, it will appeal not only to scholars of law, sociology, criminology, and media studies, but also to all those who are engaged with these topics alike.

Animal law is a growing discipline, as is animal ethics. In this wide-ranging book, scholars from around the world address the intersections between the two. Specifically, this collection focuses on pressing moral issues and how law can protect animals from cruelty and abuse. A project of the Oxford Centre for Animal Ethics, the book is edited by the Oxford Centre's directors, Andrew Linzey and Clair Linzey, and features contributions from many of its fellows. Divided into three sections, the work explores historical perspectives and ethical-legal issues such as "personhood" and "property" before focusing on five practical case studies. The volume introduces readers to the interweaving between these subjects and should act as a spur to further interdisciplinary work.

The tremendous growth in foreign direct investment (FDI) in Africa comes at a time when the field of international investment law and arbitration is witnessing a renewal. • - Ethics, Legislation, and Governance in the Age of Artificial Intelligence
    av Ugo Pagallo
    1 383,-

This book maps out the moral, legal, and societal issues brought forth by the use of autonomous systems such as AI and smart robots in outer space. Humanity is on the brink of a new space era in which projects for permanent human colonies on the Moon and space missions with autonomous AI systems will soon become a reality. Principles and provisions of international space law fall increasingly short in tackling this scenario. Experts and institutions have recommended improvements to the legal framework, such as new international agreements, or policies that would not require any amendment to conventional law. Most of the time, such proposals and recommendations overlook the challenges posed by technology and how autonomous and intelligent systems in outer space require moral and legal standards of their own. This book argues that the traditional focus on satellite communications, space-related services, and the appropriability of celestial resources needs to be integrated by new laws of outer space regulating cybersecurity law and environmental law, data governance and consumer protection. The new laws of outer space will increasingly concern the development of new standards for the behaviour and decision-making of AI systems and smart robots, with and without humans aboard deep space missions. What laws shall govern us out there, in a new terra incognita? This is the question that the book sets out to answer.

  • - Sexual Harm in the #Metoo Era
    av Brenda Cossman
    221 - 370,-

Revisits the sex wars of the 1970s and '80s and examines their influence on how we think about sexual harm in the #MeToo era #MeToo's stunning explosion on social media in October 2017 radically changed--and amplified--conversations about sexual violence as it revealed how widespread the issue is and toppled prominent celebrities and politicians. But, as the movement spread, a conflict emerged among feminist supporters and detractors about how punishment should be doled out and how justice should be served. The New Sex Wars reveals that these clashes are nothing new. Delving into the contentious debates from the '70s and '80s, Brenda Cossman traces the striking echoes in the feminist divisions of this earlier period. In exploring the history of past conflicts--the resistance to finding common ground, the media's pleasure in portraying the debates as polarized cat fights, the simplification of viewpoints as pro- and anti-sex--she shows how they have come to shape the #MeToo era. From the '70s to today, Cossman examines tensions between the need for recognition and protection under the law, and the colossal and ongoing failure of that law to redress historic injustice. By circumventing law altogether, #MeToo has led us to question whether justice can be served outside of the courtroom. Cossman argues for a different way forward--one based on reparative models that focus on shared desired outcomes and the willingness to understand the other side. Thoughtful and compelling, The New Sex Wars explores what can been learned from these stories, what traps we repeatedly fall into, how we have been denied our anger, and where to begin to make law work.

  • - Challenging the Law's Silence on Periods
    av Bridget J Crawford
    266 - 461,-

Explores the burgeoning menstrual advocacy movement and analyzes how law should evolve to take menstruation into account. Approximately half the population menstruates for a large portion of their lives, but the law is mostly silent about the topic. Until recently, most people would have said that periods are private matters not to be discussed in public. But the last few years have seen a new willingness among advocates and allies of all ages to speak openly about periods. Slowly around the globe, people are recognizing the basic fundamental human right to address menstruation in a safe and affordable way, free of stigma, shame, or barriers to access. Menstruation Matters explores the role of law in this movement. It asks what the law currently says about menstruation (spoiler alert: not much) and provides a roadmap for legal reform that can move society closer to a world where no one is held back or disadvantaged by menstruation. Bridget J. Crawford and Emily Gold Waldman examine these issues in a wide range of contexts, from schools to workplaces to prisons to tax policies and more. Ultimately, they seek to transform both law and society so that menstruation is no longer an obstacle to full participation in all aspects of public and private life.

    - Race and Reform in Criminal Justice
    av Kim Taylor-Thompson
    294,-

Provides compelling and manageable solutions for how to reform the criminal justice system from the inside out A racial reckoning in the US criminal justice system was long overdue well before the highly publicized murders of George Floyd, Breonna Taylor, and many others in 2020. Progressive Prosecution argues that prosecutors, having helped build our failed system of mass incarceration, must now lead the charge to dismantle it. With contributions from practicing district attorneys as well as leading scholars in the fields of law and criminal justice, Taylor-Thompson and Thompson's volume offers an unapologetically ambitious vision for reform. The contributors draw from empirical evidence and years of combined research experience to argue that change must happen at the local level, with prosecutors choosing to adopt race-conscious approaches. These prosecutors must do the hard work themselves, actively focusing on the ways that race misshapes perceptions of criminality, influences discretionary calls, affects how we select juries, and induces a reliance on punitive responses. Progressive Prosecution acts as both a call to action and a practical guide, instructing prosecutors on what they need to do to bring about lasting and meaningful change. Progressive Prosecution is an urgent work of scholarship, a must-read for anyone committed to racial equity and meaningful criminal justice reform.

    - Effective Legal Advocacy in Emergency Situations
    av Ray Brescia
    294,-

Shines a light on the emerging field of law dedicated to responding to and resolving the crises of the twenty-first century In an increasingly globalized world, a complex and interlocking web of nations, governments, non-state actors, laws, and rules affect human behavior. When crisis hits--whether that be extrajudicial detention, unprompted deportation, pandemics, or natural disasters--lawyers are increasingly among the first responders, equipped with the knowledge necessary to navigate the regulations of this ever more complex world. Crisis Lawyering explores this phenomenon and attempts to identify and define what it means to engage in the practice of law in crisis situations. In so doing, it hopes to sketch out the contours of the emerging field of crisis lawyering. Contributors to this volume explore cases surrounding domestic violence; dealing with immigrants in detention and banned from travel; policing in Ferguson, Missouri; the kidnapping of journalists; and climate change, among other crises. Their analysis not only serves as guidance to lawyers in such situations, but also helps others who deal with crises understand those crises--and the role of lawyers in them--better so that they may respond to them more effectively, efficiently, collaboratively and creatively. Crisis Lawyering shines a light on the emerging field of law dedicated to responding to and resolving the complex crises of the twenty-first century.

A chronicle of ableism and disability activism in New York City during the COVID-19 pandemic How to Be Disabled in a Pandemic is the first book to document the experiences of those hardest hit by the COVID-19 pandemic in New York City--disabled people. Diverse disability communities across the five boroughs have been disproportionately impacted by city and national policies, work and housing conditions, stigma, racism, and violence--as much as by the virus itself. Disabled and chronically-ill activists have protested plans for medical rationing and refuted the eugenic logic of mainstream politicians and journalists who "reassure" audiences that only older people and those with disabilities continue to die from COVID-19. At the same time, as exemplified by the viral hashtag #DisabledPeopleToldYou, disability expertise has become widely recognized in practices such as accessible remote work and education, quarantine, and distributed networks of support and mutual aid. This edited volume charts the legacies of this "mass disabling event" for uncertain viral futures, exploring the dialectic between disproportionate risk and the creativity of a disability justice response. How to Be Disabled in a Pandemic includes contributions by wide-ranging disability scholars, writers, and activists whose research and lived experiences chronicle the pandemic's impacts in prisons, migrant detention centers, Chinatown senior centers, hospitals in Queens and the Bronx, working from bed in Brooklyn, subways, schools, housing shelters, social media, and other locations of public and private life. By focusing on New York City over the course of three years, the book reveals key themes of the pandemic, including hierarchies of disability vulnerability, the deployment of disability as a tool of population management, and innovative crip pandemic cultural production. How to Be Disabled in a Pandemic honors those lost, as well as those who survived, by calling for just policies and caring infrastructures, not only in times of crisis but for the long haul.
