Der Begriff ¿Zugang zum Recht" gewinnt zunehmend an Aufmerksamkeit. Die Bedeutung dieses Begriffs bleibt aber oftmals ebenso unklar, wie die praktischen Auswirkungen, die daraus resultieren können. In diesem Werk erarbeitet der Autor eine eigene Definition des Begriffs und wendet diesen auf die arbeitsrechtliche Realität in Deutschland und Hongkong an. Hierbei verdeutlicht er regulatorische und faktische Umstände, die die Rechtsdurchsetzung durch Arbeitnehmer beeinflussen und bewertet unterschiedliche Wege, die Effektivität des Zugangs der Arbeitnehmer zum Recht zu erhöhen.

Die vorliegende Studie untersucht, wie die jesuitischen Japan-Missionare in der frühen Neuzeit christliche Inhalte in einen fremden Kontext übertragen und übersetzt haben. Dies geschieht anhand von zwei japanischen Quellen: einem ¿ ins Japanische übersetzten ¿ portugiesischen Katechismus sowie einer Sammlung biblischer Geschichten, die japanische Christen während der beinahe dreihundertjährigen Verfolgungszeit im Untergrund bewahrt und weitergegeben haben. Teile dieser Quellen werden zum ersten Mal übersetzt.

Die Conseils de Prud¿hommes sind die Eingangsinstanz für individualarbeitsrechtliche Streitigkeiten in Frankreich. Die Autorin analysiert die französischen Gerichte und vergleicht ausgewählte Aspekte mit den deutschen Arbeitsgerichten. Neben der historischen Entwicklung, der Organisation und der Zuständigkeit gilt ein besonderes Augenmerk der Besetzung der Conseils de Prud¿hommes ausschließlich mit Richtern aus dem Kreis der Arbeitnehmer und aus dem Kreis der Arbeitgeber (conseillers). Vertieft behandelt wird zudem das Verfahren. Die Ausführungen bieten Einblicke in eine geschichtsträchtige Institution, die innerhalb Europas einzigartig ist und auch die deutschen Arbeitsgerichte prägte.
