Zivilsenat des Bundesgerichtshofs aufgestellten Gleichwertigkeitskriterien einer umfassenden Analyse und zeigt das Erfordernis zusätzlicher Kriterien auf. Die Arbeit greift exemplarisch die Beurkundung durch die Urkundspersonen in vier Schweizer Kantonen heraus, welche Gegenstand zahlreicher Entscheidungen deutscher Gerichte gewesen sind. In rechtstatsächlicher Hinsicht werden die Motive für den ¿Beurkundungstourismus¿ im Lichte der Ergebnisse einer Befragungsstudie untersucht.
